1. Agreement and eligibility
These Terms form an agreement between you and Dserve Inc. By creating an account or using DSERVE, you agree to these Terms and our Privacy Policy. You must be at least 18 years old and legally able to enter into this agreement.
2. DSERVE’s role
DSERVE is a technology marketplace that connects customers with independent service partners. Service partners are not DSERVE employees. DSERVE facilitates discovery, booking, communication, documentation, payment, and support but does not itself perform the booked home service.
3. Accounts and verification
- You must provide accurate, current information and keep your account secure.
- You may not share your account, password, OTP, or provider wallet PIN.
- Service partners may be required to submit identity, qualification, and service information for review.
- DSERVE may restrict or suspend accounts to investigate fraud, safety concerns, unpaid obligations, or violations of these Terms.
4. Bookings and service scope
Customers must provide an accurate address, schedule, description, selected areas, and other requested information. Photos and automated assessments help document scope but do not guarantee that every condition is visible. A provider may raise a scope concern through DSERVE when actual conditions materially differ from the booking.
Customers must provide safe and lawful access to the service location. Providers must perform only services they are approved and qualified to deliver and must follow the in-app checklist and evidence rules.
5. Prices, payments, and provider earnings
Customers see the Final Service Price before confirming a booking. Transportation is included in that final amount and is not presented as a separate customer charge. A customer-approved radius or service change may update the price before confirmation.
Cashless payments are processed by third-party payment providers such as Xendit. DSERVE does not store complete card numbers. A payment is not complete until DSERVE receives authoritative confirmation from the payment provider.
Provider earnings are recorded in the DSERVE Wallet after the booking reaches the required completion and settlement state. DSERVE retains a 15% platform commission from the commissionable service amount; transportation is excluded from that commission. Withdrawal limits, review periods, destination requirements, and payment-provider fees may apply and will be shown or communicated before processing.
6. Cancellations, refunds, and disputes
Cancellation eligibility and any applicable charge depend on the booking’s status, payment method, provider dispatch, and current policy shown in DSERVE. Cashless refunds may require a security and reconciliation review and are not guaranteed to be immediate. Customers and providers must submit truthful evidence. DSERVE may review photos, checklists, messages, transaction records, and status history when resolving a dispute.
7. Acceptable conduct
- No harassment, discrimination, threats, violence, theft, or unsafe conduct.
- No illegal, hazardous, deceptive, or unauthorized services.
- No false photos, reviews, payment claims, completion evidence, or identity documents.
- No attempts to bypass DSERVE security, payment, wallet, or booking controls.
- Customers and providers must respect property, privacy, building rules, and lawful safety requirements.
8. Independent service partners
Service partners control whether to make themselves available and whether to accept eligible jobs. They are responsible for their work methods, tools required by their approved service, taxes, permits, professional conduct, and legal obligations. Nothing in these Terms creates an employment, agency, partnership, or joint-venture relationship with DSERVE.
9. Platform availability and third parties
DSERVE depends on internet, cloud, mapping, notification, identity, app-store, and payment services operated by third parties. Features may be interrupted for maintenance, security, provider availability, or circumstances outside our reasonable control. We may improve, replace, pause, or discontinue features while protecting existing booking and financial records.
10. Liability
To the extent permitted by Philippine law, DSERVE is not responsible for indirect, incidental, special, or consequential loss. DSERVE does not guarantee a provider’s availability or the outcome of independent services. Nothing in these Terms excludes liability that cannot legally be excluded, including rights available under applicable consumer and data-protection law.
11. Account deletion and termination
You may initiate deletion from your DSERVE profile. A 30-day grace period allows you to cancel the request. Active bookings, disputes, refunds, provider earnings, or withdrawals may need to be resolved, and records required by law may be retained. Sections that reasonably need to survive termination—including payment, dispute, liability, and legal provisions—remain effective.
12. Governing law and updates
Philippine law governs these Terms. The parties should first try to resolve disputes through DSERVE support in good faith. Courts or other lawful dispute-resolution bodies will have jurisdiction as provided by applicable law. We may update these Terms and will post the revised date. Material changes may also be communicated through the app or account contact information.
